Effective Date: January 1, 2026
These Terms and Conditions (“Terms”) govern the relationship between When You Wish Travel LLC, a Georgia limited liability company (“When You Wish Travel,” “WYWT,” “we,” “us,” “our”), and the purchaser and/or traveler (“Client,” “Traveler,” “you,” “your”). By requesting services from WYWT, approving an itinerary, submitting payment authorization, executing any booking or planning agreement, or traveling on a reservation arranged by WYWT, Client acknowledges that Client has read, understands, and agrees to be legally bound by these Terms.
WYWT acts solely as a booking agent for third-party suppliers, including but not limited to airlines, cruise lines, hotels, resorts, tour operators, ground transportation providers, and other independent contractors (collectively, “Suppliers”). WYWT is not the provider of travel services and does not control or operate any Supplier.
1. AUTHORITY TO CONTRACT; ACCURACY OF INFORMATION
Client represents and warrants that Client is at least eighteen (18) years of age and has full legal authority to enter into this Agreement and to make travel arrangements for Client and/or all members of Client’s traveling party. Client agrees to be jointly and severally liable for all obligations, charges, and representations made on behalf of all travelers included in any booking.
Client warrants that all information provided to WYWT is complete, true, and accurate, including but not limited to legal names as shown on government-issued identification, dates of birth, passport information, citizenship, and contact information. Client assumes sole responsibility for errors, omissions, or discrepancies.
Speculative, false, or fraudulent reservations are prohibited.
2. SUPPLIER TERMS CONTROL
All travel services are subject to the separate terms and conditions of the applicable Supplier(s). By approving any itinerary, proposal, invoice, or booking, Client expressly agrees to be bound by all Supplier terms, conditions, limitations, and policies, including but not limited to cancellation, refund, force majeure, and liability provisions.
WYWT is not responsible for, and shall have no liability arising from, Supplier acts, omissions, failures, insolvency, schedule changes, or policy enforcement.
3. INDEPENDENT ARRANGEMENTS
WYWT assumes no responsibility for any travel arrangements made independently of WYWT. If Client books flights, accommodations, transportation, excursions, or other services outside of WYWT, Client assumes all risks, including schedule changes, cancellations, missed connections, and loss of funds. WYWT has no obligation to assist with independently booked components.
4. PRICING, AVAILABILITY, AND ERRORS
All pricing and availability are subject to confirmation. WYWT reserves the right to correct any pricing or availability errors at any time. In the event of an error, WYWT may revise pricing, offer alternatives, or cancel the booking in accordance with Supplier policies. Client has no right to enforce an erroneous price.
5. PAYMENTS; AUTHORIZATION; CHARGEBACK PROHIBITION
Client authorizes WYWT to charge Client’s authorized payment method for all deposits, installments, final payments, change fees, cancellation penalties, planning fees, and other charges approved by Client.
All payments are due in accordance with Supplier payment schedules. Failure to remit payment by required deadlines may result in cancellation without refund.
CHARGEBACKS.
EXCEPT IN CASES OF VERIFIED FRAUD, CLIENT EXPRESSLY AGREES NOT TO INITIATE ANY CHARGEBACK, PAYMENT DISPUTE, OR REVERSAL WITH ANY FINANCIAL INSTITUTION FOR CHARGES AUTHORIZED BY CLIENT.
If Client initiates a chargeback, Client agrees to reimburse WYWT for all losses, fees, administrative costs, collection costs, and reasonable attorneys’ fees incurred by WYWT in responding to such chargeback.
6. CANCELLATIONS AND CHANGES
All cancellation and change requests must be submitted in writing. Supplier cancellation penalties apply and may be up to 100% of trip cost. WYWT makes no guarantees regarding refunds. Client is responsible for all increased costs, Supplier penalties, and applicable agency fees associated with changes.
Unused travel components are non-refundable unless expressly permitted by the Supplier.
7. TRAVEL DOCUMENTS AND IDENTIFICATION
Client is solely responsible for obtaining and carrying all required travel documents, including passports, visas, vaccinations, and entry permits. Many destinations require passports valid at least six (6) months beyond return date.
Client is responsible for ensuring that names and personal details exactly match government-issued identification. WYWT bears no responsibility for denied boarding, entry refusal, or additional costs resulting from documentation errors.
Client must review all documents upon receipt and notify WYWT of errors within twenty-four (24) hours. Failure to do so releases WYWT from responsibility for correction costs.
8. ENTRY, EXIT, AND CRIMINAL HISTORY
Each destination determines its own entry and exit requirements. Client is solely responsible for verifying admissibility, including issues related to criminal history. WYWT does not inquire into criminal records and bears no liability for denied entry, removal, or deportation.
9. HEALTH, MEDICAL CONDITIONS, AND IMMUNIZATIONS
Client is solely responsible for determining fitness for travel and complying with all health and vaccination requirements. WYWT does not provide medical advice and makes no representations regarding medical facilities, prescription availability, or health risks at any destination.
10. ACCESSIBILITY AND SPECIAL NEEDS
WYWT will relay accommodation requests to Suppliers but does not guarantee accessibility, suitability, or compliance. Suppliers may impose additional charges or limitations. WYWT bears no responsibility for Supplier failures related to accessibility or special needs.
11. ASSUMPTION OF RISK
Travel involves inherent risks including illness, injury, death, delay, cancellation, crime, weather events, and acts of third parties. Client knowingly and voluntarily assumes all risks associated with travel and participation in activities, including those involving physical exertion or remote locations.
WYWT makes no representation that travel to any destination is safe or advisable.
12. AIR TRAVEL DISCLAIMERS
Airline tickets constitute a contract between Client and the air carrier. WYWT has no control over airline operations and bears no liability for schedule changes, delays, cancellations, seat assignments, baggage handling, denied boarding, or airline insolvency.
Seat assignments are not guaranteed. Airline fees and policies apply.
13. FORCE MAJEURE
WYWT shall not be liable for failure or delay in performance due to events beyond its reasonable control, including but not limited to acts of God, pandemics, natural disasters, war, terrorism, labor disputes, governmental actions, or Supplier insolvency.
Supplier force majeure provisions control refund eligibility. Travel insurance is strongly recommended.
14. CLIENT CONDUCT AND INDEMNIFICATION
Client is responsible for conduct during travel and for all damages caused by Client. Client agrees to indemnify, defend, and hold harmless WYWT from any claims, damages, losses, liabilities, costs, or expenses arising from Client’s acts or omissions.
Suppliers may remove Client from travel without refund for misconduct or safety concerns.
15. LIMITATION OF LIABILITY; DAMAGES WAIVER
WYWT acts solely as an agent for disclosed principal Suppliers and does not control Supplier operations.
TO THE MAXIMUM EXTENT PERMITTED BY LAW:
WYWT SHALL NOT BE LIABLE FOR ANY PERSONAL INJURY, DEATH, PROPERTY DAMAGE, LOSS, DELAY, OR EXPENSE ARISING FROM SUPPLIER ACTS OR OMISSIONS.
WYWT SHALL NOT BE LIABLE FOR ANY PUNITIVE, EXEMPLARY, MULTIPLIED, SPECIAL, INCIDENTAL, OR CONSEQUENTIAL DAMAGES.
CLIENT EXPRESSLY WAIVES ANY RIGHT TO SEEK SUCH DAMAGES.
LIABILITY CAP.
WYWT’S TOTAL LIABILITY, IF ANY, SHALL NOT EXCEED THE COMMISSIONS AND/OR FEES ACTUALLY RECEIVED BY WYWT FOR THE TRAVEL SERVICES GIVING RISE TO THE CLAIM.
16. TRAVEL INSURANCE
WYWT strongly recommends travel insurance. WYWT does not guarantee claim approval or coverage outcomes. Client is responsible for reviewing policy terms and exclusions.
17. MODIFICATION OF TERMS
WYWT reserves the right to modify these Terms at any time. Updated Terms are effective upon posting.
18. GOVERNING LAW; VENUE; TIME LIMIT; CLASS ACTION WAIVER
These Terms are governed by the laws of the State of Georgia. Venue for any dispute shall lie exclusively in the state or federal courts located in Richmond County, Georgia.
Any claim must be brought within twelve (12) months of the conclusion or scheduled conclusion of travel.
Client waives any right to bring claims as part of a class action, collective action, or representative proceeding.
19. SEVERABILITY; ENTIRE AGREEMENT
If any provision is deemed unenforceable, the remaining provisions shall remain in full force. These Terms constitute the entire agreement between Client and WYWT and supersede all prior communications.
