These Terms and Conditions (“Terms”) govern the relationship between When You Wish Travel LLC (“we,” “us,” “our”) and you, the purchaser or traveler (“Client” and “passenger” and “you/your”). By booking travel services with When You Wish Travel LLC, you agree to be bound by these Terms. We act solely as a booking agent for the disclosed principal supplier tour operators, cruise lines, hotels, airlines, and other independent contractors providing accommodations, transportation, and other services (“Supplier(s)”). These Terms include warranties, disclaimers, and exclusions of liability, which may limit your rights.
1. USE OF OUR SERVICES, ACCESS, AND INFORMATION FOR TRAVEL BOOKINGS
You warrant that you are at least 18 years old and possess the legal authority to enter into this Agreement and make travel bookings. You agree to be financially responsible for all travel bookings made by you or on behalf of others. You warrant that all information provided by you is accurate. You agree only to make legitimate reservations or purchases. By booking travel through When You Wish Travel LLC, you agree to abide by the Terms and Conditions of each Supplier involved in your itinerary. We are not liable for independent arrangements made without us. We are not responsible for any changes or cancellations related to flights, accommodations, or services not booked through us.
2. RIGHT TO CORRECT ERRORS AND OFFERS SUBJECT TO AVAILABILITY
We reserve the right to correct errors in pricing or availability. All offers, incentives, and Supplier promotions are subject to availability and may change without notice. We recommend confirming your reservations in advance to avoid any potential issues.
3. PAYMENTS, CANCELLATIONS, AND CHANGES TO BOOKINGS
You are responsible for all charges, fees, and taxes arising from your travel bookings. By submitting a credit card authorization, you permit When You Wish Travel LLC to process payments for travel products on your behalf. You agree not to dispute charges for travel bookings you have authorized. All payments must be completed before departure, according to Supplier terms. Failure to make final payment may result in the cancellation of your reservations and loss of any paid funds. Cancellations and changes are subject to the Supplier’s policies, and you may be responsible for penalties or additional fees.
4. TRAVEL DOCUMENTS, INCLUDING TSA AND DHS REQUIREMENTS
It is your responsibility to obtain and carry valid travel documents, including passports and visas, as required by your destination. We are not responsible for the issuance of travel documents or for any issues arising from discrepancies between your travel documents and booking details.
5. INDIVIDUAL ENTRY AND EXIT REQUIREMENTS
Certain countries have specific entry and exit requirements, especially concerning criminal records. It is your responsibility to verify and comply with these requirements. We do not inquire about criminal records in order to respect your privacy.
6. IMMUNIZATIONS AND HEALTH REQUIREMENTS
You must ensure that you have the necessary immunizations and health documentation for your destination. We do not assume responsibility for the accuracy of health and vaccination requirements.
7. TRAVELERS WITH DISABILITIES OR SPECIAL NEEDS
If you have special needs, please inform us in advance so that we can arrange appropriate services. We are not responsible for the failure of Suppliers to meet accessibility standards or for additional charges related to special services.
8. RISKS AND SAFETY
Travel to certain destinations may involve risks. We advise you to stay informed about current travel advisories and health and safety conditions. By booking travel to such destinations, you accept the risks involved. We are not liable for any incidents that may occur during your travel.
9. LIMITATIONS OF RESPONSIBILITY AND DISCLOSURE
When You Wish Travel LLC acts solely as a booking agent for Suppliers. Each Supplier is an independent entity, and we are not responsible for their actions or services. You agree that we are not liable for any damages, injuries, or losses arising from services provided by Suppliers.
10. FORCE MAJEURE
We will not be liable for any failure or delay in performing our obligations due to causes beyond our control, including natural disasters, pandemics, or governmental actions. We recommend purchasing comprehensive travel insurance to protect against such events.
11. CLIENT CONDUCT
You are responsible for any damage or loss caused by you during your travel. You agree to indemnify us for any claims arising from your actions. We are not responsible for any costs associated with your removal from a trip due to misconduct.
12. TRAVEL INSURANCE
We strongly recommend purchasing travel insurance. Without it, you may be responsible for any financial loss due to trip cancellations, delays, or other unforeseen events. We do not guarantee coverage approval by any insurance provider.
13. RESERVATION OF RIGHTS AND CHANGES TO THESE TERMS
We reserve the right to update these Terms at any time. Updated versions will be posted on our website and will be effective immediately upon posting.
14. GOVERNING LAW
These Terms are governed by the laws of the State of Georgia. Any disputes arising from these Terms shall be resolved in the courts of Richmond County, Georgia. You agree to bring any claims within 12 months of the completion of your trip.
